Constituent Concern Inspection
A Constituent Concern Inspection (CCI) is a special education investigative process to determine if a provider of special education is in compliance with state and federal special education law, governing the education of Nevada pupils with disabilities. With a CCI, the constituent will be notified whether the alleged violation meets the requirements to initiate an investigation, however notice is not provided to the constituent regarding the final result of the inspection. In addition, while a CCI request is filed with the Superindendent, and the constituent does not have to provide the school a copy of the request, this process does not provide anonymity for the constituent. The CCI process does not apply to determinations of compliance with Section 504 or the Americans with Disabilities Act (ADA). NRS §388.4354 provides the authority for the Superintendent to take appropriate measures if a provider is found out of compliance and fails or refuses to comply in a timely manner.
The Nevada Department of Education (NDE) is a neutral party and cannot provide guidance on situations or concerns that may be addressed during a Constituent Concern Inspection.
What to Expect with a Constituent Concern Inspection
A Constituent Concern Inspection (CCI) may be initiated by a person, organization, or governmental agency to include the state Superintendent at his/her own initiative. When a Constituent Concern Inspection is requested, NDE will verify that the request is filed in the required manner, pertains to issues that NDE has authority to investigate, and determine whether there is good cause to conduct an inspection. The determination of good cause may include, but is not limited to consideration of whether the request provides enough information to determine whether the alleged violation occurred and the date on which the alleged violation occurred. The constituent will be notified of the determination regarding the request for an inspection, and if not accepted, NDE will provide information on how to re-file if desired. After a determination of good cause, inspections must be completed within 30 days. If the provider is found to be out of compliance, NDE will meet with the provider within 30 days of the finding of non-compliance to determine how to bring the provider in compliance with the identified law or regulation, and the board of trustees of the school district or charter school will be required to submit a corrective action plan to NDE for approval.
