The Nevada Department of Education (NDE) is notifying the public and appropriate Local Educational Agencies (LEAs) of its intent to submit a request to the U.S. Department of Education for a 12-month Tydings waiver. This waiver, pursuant to section 421(b) of the General Education Provisions Act (GEPA), seeks to extend the period of availability for the Bipartisan Safer Communities Act (BSCA) state set-aside funds.

The NDE is currently utilizing these funds for a statewide campaign to reduce chronic absenteeism. While early results show reductions in absenteeism of 5% to 13% in participating districts, Nevada continues to face high rates of absenteeism that require sustained, multi-year interventions.

If granted, this extension will allow NDE to:

• Scale Interventions: Expand evidence-based programming to additional high-need LEAs that have not yet been reached.
• Solidify Outcomes: Move beyond temporary gains to create a permanent cultural shift toward consistent school attendance.
• Maximize Fiscal Impact: Ensure all approved activities are completed and every dollar is directed toward student re-engagement.

This is a state-level waiver regarding set-aside funds and does not negatively impact local school system allocations.

In accordance with federal regulations, NDE is providing a reasonable opportunity for the public and LEAs to submit comments on this request.
